TPLF Reform Efforts Reveal a Sharp Partisan Divide—and an Unexpected Alignment

Two bills requiring disclosure of third-party litigation funding (TPLF) were slated for debate and vote by the House Judiciary Committee this month. One bill advanced on November 18, apparently the first TPLF-related bill to pass out of a congressional committee. The other bill stalled, highlighting sharp partisan divides as well as an unexpected alignment between Democrats and conservative policy groups. Meanwhile, a senator from Louisiana has reintroduced related legislation, echoing that state’s 2024 law requiring disclosure of litigation funding agreements involving foreign financiers.
