When “Volume Alone” Becomes a “Pattern of Litigation Abuses”

William P. Ramey, III, the principal of frequent plaintiff-side law firm Ramey LLP, has asked Western District of Texas Judge Alan D. Albright for emergency relief from a recent sanctions order. That order requires Ramey and Ramey LLP to get permission before filing any patent infringement complaint in West Texas. Ramey asks the court to stay imposition of that sanction pending resolution of an appeal in the underlying case—filed by mCom IP, LLC against Cisco. The appeal concerns Judge Albright’s concurrent shift of roughly $73K in attorney fees to Cisco. Meanwhile, for the second time, the Federal Circuit has affirmed a shift of attorney fees against a Ramey-repped client, this time endorsing an award of $161K against Ortiz & Associates Consulting, LLC to VIZIO.
