Driving Innovation Refiles Case Against Toyota

Driving Innovation LLC sued Toyota (Toyota Motor North America) in the Eastern District of Texas last October. Toyota filed a motion to dismiss based on Alice and pleading inadequacies as well as a motion for an intradistrict transfer. Those motions were fully briefed when the plaintiff voluntarily dismissed the case without prejudice and filed a new complaint in the same district (and division) (2:26-cv-00411). Among other things, Driving Innovation has swapped out patents, extended the list of accused products, and beefed up its marking-related pleading.
